Driver App Privacy Statement

We consider privacy to be an important right. We therefore believe it is essential that we securely store and properly protect your personal information. We use your information for the purpose of providing you with a better service in a respectful manner.

To us, the right to privacy also means that everyone should have control over their own personal data and, therefore, should be free to decide not to share this information with us (any longer). This Privacy Statement outlines the personal information we collect, how we use it and with whom we might share it. It also lists the measures we have taken to protect your privacy, how you can participate in its protection and what checks are carried out to ensure compliance with our Privacy Statement.

This Privacy Statement applies to the collection, management, use and sharing of your personal data by Young & Partners Belgium NV. This Privacy Statement should be read in conjunction with our cookie policy. We can amend our Privacy Statement at any time and will post the latest version on our website https://www.navitrans.eu/. a) Driver/User Data

We collect your data when you carry out transport orders for your contractor or your employer. The following data may be collected:

Personal data provided by your contractor or employer for the execution of a contract as well as any additional data for processing on the basis of your express consent (e.g. title, first name, surname, telephone number, e-mail address, position, registration number of your vehicle, transaction information in connection with the execution of transports, including place and time of the Services requested and provided) in which case you bear the responsibility on its accuracy, as well as data which you share with our customer support for the processing of a request. If your data is no longer up to date, we kindly ask you to notify us.

b) Location Data

Our services may require that we record the location data of vehicles before, during and after the execution of transports and pass this data on to your contractor or employer. This recording is done by GPS via telematics integration or via a mobile app. We only collect such data if the users have given us permission to do so via the authorization system used by the telematics system or mobile app. If you do not want us to collect data as described above, you must switch off the relevant systems. However, this may mean that you will not be able to carry out orders for your contractor or employer.

When using the mobile app, the location data is collected and passed on to your contractor or employer. We recommend that you read the data protection information of your contractor or employer to understand how your personal data is processed.

c) Camera data

Access to the camera is used to capture photos from the device and send these to your contractor or employer. If you do not want us to collect data as described above, you must switch off the relevant systems. However, this may mean that you will not be able to carry out orders for your contractor or employer.

d) The purpose of processing and legal basis

We collect your data for contract execution with your contractor or employer (e.g. quality assurance, product and service-related communication), to provide, personalise, maintain and improve products and services.

We also use your data to track the status and location of the freight you are transporting and related data, e.g. to determine the time of arrival and departure of a vehicle at the loading or unloading points and to inform customers about the status of a transport by providing appropriate GPS data.

e) Sharing your data

We will share your data with third parties who store your data on their servers. The types of third parties with whom we share your data include:

  • Your contractor or employer and our contractors and customers as well as other users or third parties who need or request this data in connection with our products and Services, such as operators of pick-up points or reception facilities;
  • external service providers or other contractors (e.g. for data processing and hosting, for order processing and execution, for shipping, transport and logistics, feedback and survey providers, telematic service providers and call centres);
  • other external bodies, provided that the data subject has given his or her consent or if transmission is permitted for reasons of overriding interest, e.g. for creditworthiness information, for the electronic transmission of information, for quality assurance purposes.
  • Public bodies if the appropriate statutory provisions exist (e.g. tax authorities and customs authorities).

We only share your data with our personnel and with personnel of other companies of the Navitrans group if this is necessary for the purposes described above.

We may also share your data if we should enter into a joint venture, buy, sell or merge with another company. In such a case, your data may be shared with the target company, our new business partners or owners or their advisors.

It is possible that one or more of the aforementioned third parties are located outside the European Economic Area (“EER”). However, personal data will only be transmitted to third countries with a suitable level of protection.

The employees, managers and/or representatives of the aforementioned service providers or institutions and the specialised service providers they appoint must respect the confidential nature of your personal data and may only use this data in the context in which it was transmitted.

If necessary, your personal data can be passed on to other third parties. This may be the case, for example, if we were to be entirely or partly reorganised, our activities were to be transferred or if we were to be declared bankrupt. It is also possible that personal data has to be passed on as a result of a court order or in order to comply with a specific legal obligation. In that case, we will make reasonable efforts to inform you in advance of this transmission to other third parties. However, you will acknowledge and understand that this is not always technically or commercially feasible in certain circumstances, and that possible legal restrictions may apply.

f) Duration of storage

The personal data is stored and processed by us for a period that is necessary or statutory obliged, depending on the purposes of this processing and depending on the relationship (contractual or otherwise) that we have with you.

The data will generally be removed from our system after a period of ten years, except for the personal data that we are obliged to keep for longer on the basis of specific legislation or in the event of an ongoing dispute for which personal data is still necessary.

g) Rights

In accordance with and under the conditions of the Belgian privacy legislation and the conditions of the GDPR, we inform you that you have the following rights:

  • Right to access: you have the right to find out free of charge what data we have about you and to check what it is used for.
  • Right to rectification: you have the right to obtain rectification (correction) of inaccurate personal data concerning you, and the right to have incomplete personal data completed.
  • Right to erasure or restriction of processing: you have the right to request that we erase your personal data or to limit its processing in the circumstances and under the conditions determined by the GDPR. We can refuse to erase or restrict the processing of any personal data that we require to fulfil a legal obligation, implement a contract or that is in our legitimate interest, for as long as this data is necessary for the purposes for which it was collected.
  • Right to data portability: you have the right to receive the personal data with which you provided us in a structured, commonly used and machine-readable format. You have the right to transmit this data to another controller for processing.
  • Right to object: you have the right to object to the processing of your personal data on compelling, legitimate grounds. However please note that you cannot object to the processing of personal data that we require to fulfil a legal obligation, implement a contract or exercise our legitimate interest, for as long as this data is necessary for the purposes for which it was collected.
  • Right to withdraw consent: if the processing of personal data is based on prior consent, you have the right to withdraw this consent. This personal data will then only be processed if we have another legal basis for doing so.
  • Automated decision-making, including profiling: we confirm that the processing of personal data does not include any profiling and that you are not subjected to solely automated decision-making.

We have 30 days to respond to your request. This period starts from the moment we receive your written request and have all the information we need to comply with your request.

We make every effort to treat your personal data with care and in a legitimate manner, in accordance with the regulations in force. h) Technical and organisational measures

We take the necessary technical and organisational measures to process your personal data with an adequate level of security and to protect it against destruction loss, falsification, alteration, unauthorised access or erroneous transmission to third parties, as well as all other unauthorised processing of this data.

Under no circumstances can Young & Partners Belgium NV be held liable for any direct or indirect damage resulting from wrongful or illegitimate use of the personal data by a third party.
